According to the video, done by a well-known content creator on TikTok, some Kenyans have secretly discovered a means to find legitimate work in the U.S.

According to the Content Creator, he is a truck driver who occasionally visits rural states in America to pick up supplies from farmers. Through his adventures, he’s met many Kenyans and Zimbabweans working on those farms.
He’s been curious how they stumbled upon the lucrative opportunity to work on farmlands in rural America and discovered a well-kept secret in the name of the H-2A Temporary Visa. According to the Kenyan content creator, the visa is issued by the United States government through farmers who are short of workers.
The content creator was keen to say that agricultural workers can only get the H-2A Temporary Visa through a farm owner.
I’ll be honest. This is the first time I’ve heard of an H-2A Temporary Visa, so I decided to do a little digging.
What is a H-2A Temporary Visa?
The H-2A Temporary Visa is actually a temporary agricultural program that can be attained through the United States Foreign Labor Application Gateway, also known as the FLAG system. The Kenyan content creator described this portal.
The H-2A Temporary Visa is actually very new, and several changes have been made as of April 29, 2024. According to this program, the American Labor Department allows H-2A workers when there is a shortage of qualified U.S. workers.
The H-2A Temporary program allows farmers and stakeholders in agriculture to bring in nonimmigrant foreign workers into the United States to work as agricultural laborers or offer temporary, seasonal help when there is a shortage. It’s ideally a temporary work Visa but for domestic agricultural laborers.
How Long can Someone Stay in the United States with a H-2A Temporary Visa?
According to the United States Department of Labor, employment offered via the H-2A Visa is temporary. As such, these opportunities only arise when farmers or employers in the agricultural sector in the United States feel there is a shortage and need to fill the position with a temporary worker.
As a bonus, the U.S. government protects these workers through statutes and regulations concerning salaries and working conditions.
How can I get a H-2A Temporary Visa?
It’s not as simple as it seems. The application must first be made by a farmer in the United States seeking to add workers to their farm. Simply put, you must be invited by a farmer or agricultural institution looking for a foreign workforce. The Visa can only be granted if the farmer proves there is a shortage of qualified United States workers.
The first step involves the farmer (petitioner) accessing an online portal by the United States Department of Labor. The portal is known as the Foreign Labor Application Gateway, also known as the FLAG System.
